Terms & Conditions

The following Terms and Conditions apply to all services of Viviane Langner (Your Truth), and any collaborations that Viviane Langner is part of.

Understanding

  1. The terms and conditions below apply to all coaching services as well as workshops and other events provided by Viviane Langner (as of now called 'Viviane') and constitute the contract for the service to be provided by Viviane for the client. The term 'event' as used here covers workshops, retreats, festivals, and multiple-day events.
  2. Coaching or participation in events is not psychological counselling or any type of therapy, and should not be construed as such.
  3. In return for the fees payable by the client (or by a third party on their behalf), Viviane agrees to provide the service as described and in accordance with the terms and conditions set out below. The client agrees to pay fees for the service on the terms and conditions set out below (in situations where a third party pays the fees, the third party counts as an agent acting on behalf of the client).
  4. The date that the first coaching session takes place shall be deemed to be the start date for the service. Participation by any individual in the first coaching session or event constitutes acceptance of these terms and conditions.

Responsibility & Commitment

  1. Viviane will seek to enable the client to set and achieve goals that will help to bring about desired outcomes for the client. The client has sole responsibility for any decisions they may make following coaching with Viviane. Viviane accepts no liability for the client's actions. Viviane has no liability for any loss incurred by any client, following commencement of coaching sessions, or for any perceived failure by the client, whether justified or otherwise, to achieve improvement in the quality of life or to achieve their desired outcomes or goals.
  2. For sessions including physical contact, Viviane takes responsibility for her physical hygiene. Viviane asks the client to do the same. Personal hygiene includes being showered, wearing clean clothes, having no contagious diseases, not using any intense perfumes, etc. Viviane beholds the right to refuse clients who have insufficient physical hygiene. She will provide the client with feedback in this case.

Confidentiality

  1. Personal or other information supplied to Viviane by the client in coaching or group sessions will be treated as confidential. It will not be disclosed to a third party without the client's prior permission, save where required by law.
  2. How we take care of your Personal Data, can be found in my Privacy Statement.

Clarity & Style

  1. Viviane will discuss with the client their preferred style of coaching. The client has the right to talk openly and candidly with their coach, and the client is encouraged to discuss any concerns they have with Viviane on any area of the coaching process. Viviane welcomes openness and honesty.
  2. Feedback about the service is welcomed and can be given during a coaching or group session, or by writing to Viviane at her provided email address.
  3. Viviane strives to continuously upgrade the standard of service she provides to clients. At the end of the coaching process or after a series of coaching sessions, the client can be asked to complete a feedback form.

Individual Coaching Procedure

  1. The coaching schedule will be arranged between Viviane and the client during the intake session. Viviane will recommend the frequency of coaching sessions based on a professional assessment of the client's requirements. This recommendation, or plan, is not binding and may be altered and adjusted throughout the coaching journey by mutual agreement, in accordance with the terms set out in this agreement.
  2. The number of coaching sessions will be agreed upon at the start of coaching between Viviane and the client. Where no specific number is agreed, sessions will be provided on a session-by-session basis. Due to the nature of coaching, the initial term usually recommended is three sessions. Full payment for the first session is due before or at the first session. Additional sessions can be booked thereafter.
  3. The length of each session is usually 1 hour.
  4. Coaching will take place between the client and their coach face-to-face, via Zoom (Viviane calls client), or by telephone (Viviane calls client). Face-to-face coaching will take place at a mutually agreed venue. Where coaching takes place at a mutually agreed venue, the client will be liable for any costs incurred by Viviane at that time.
  5. Viviane may assign the client tasks or exercises to complete between coaching sessions. There is no obligation on the client to complete these tasks, but not doing so may slow the client's progress in gaining improved quality of life or achieving desired outcomes. Where possible, clients are requested to submit any information requested by Viviane relating to assignments at least 24 hours before the coaching session when they are to be discussed. Viviane will provide feedback on completed assignments during coaching sessions.
  6. The client may contact Viviane by email between sessions to share a success or seek clarification on a coaching issue. Support between sessions is seen by Viviane as a necessary part of the coaching process. Viviane will always advise a client in advance if the nature of a client's contact is likely to incur an additional charge, and no such charges will be imposed without the client's agreement.

Cancellation Policy and Refunds for Individual Sessions

  1. If the client needs to rearrange a coaching session, they should provide at least 48 hours' notice. No refunds will be given to clients for unused coaching sessions unless 48 hours' notice has been given. In exceptional circumstances, Viviane may need to rearrange a coaching session; in these circumstances, Viviane will use reasonable endeavors to provide a mutually satisfactory alternative appointment to the client.
  2. The client may terminate their coaching journey at any time in writing. Any payments owed at the time of cancellation will become due immediately.
  3. In exceptional circumstances, such as illness or unavailability due to bereavement or other commitments, inappropriate behavior by the client, an actual or potential conflict of interest, or other reasons, Viviane can decide to terminate the service to the client early or refuse or be unable to provide further coaching sessions to the client. In such a circumstance the client will be given reasonable notice of termination where practicable.
  4. When a client disrespects boundaries or otherwise behaves inappropriately, Viviane has the right to stop the coaching session immediately without refunding the coaching fee. Viviane beholds the right to refuse a client or refuse certain types of sessions with a client. In case of a workshop or event, Viviane beholds the right to exclude the client from the workshop or event, without refunding the ticket. Inappropriate behavior includes (but does not exclude other behavior):
    • Touching Viviane without prior consent.
    • Sexual interaction.
    • Inappropriate behavior in group events (touching others without consent, crossing boundaries of others, disrespectful language, not respecting guidance by Viviane and her team).
    • Disrespecting other boundaries stated by Viviane.
  5. There may be occasions when Viviane may recommend to the client that they seek an alternative service more suited to their current needs. In this event, Viviane will fully discuss the reasons for the recommendation with the client. It is the client's sole responsibility to decide whether to follow the recommendation and Viviane does not accept any liability for the outcome of any decisions the client chooses to make.

Cancellation Policy and Refunds for Workshops and Events

  1. Tickets for events are not subject to refunds by law, and therefore, refunds do not have to be offered. As a service, though, there are options to get a refund. The refund has to be requested at least one week before the event takes place. Refunds can only be requested via email. This email should include the name of the person who bought the tickets and the name and date of the event. There are administration costs involved with refunds:
    • Tickets for group events consisting of an evening: The ticket price will be refunded, minus €5,- admin fee per ticket.
    • Tickets for full-day group events: The ticket price will be refunded, minus €15,- admin fee.
    • Refunds are not possible when a ticket buyer has to refrain from participating due to sickness, flu, Covid-19, etc., within a month before the event.
  2. Instead of a refund, the ticket owner may choose to sell their ticket to another person. This is also an option within a week before the event. group events does not mediate in or support ticket reselling. When the ticket is gendered, the ticket must be sold to someone identifying with the same gender as the seller – this is to prevent the overrepresentation of a specific gender in workshops and events. The ticket seller is responsible for providing the ticket buyer with all appropriate information about the workshop or event, including the venue address when that is different from the address printed on the ticket, and any email sent before or after the event, concerning the event. The ticket seller informs group events via email who is coming instead, including the name and email address of the ticket buyer, and the name and date of the event.
  3. When the group event is prohibited by circumstances beyond Viviane's control, e.g. government regulations, venue bankruptcy, etc.:
    • The workshop or event is not cancelled when Viviane offers a product of at least a similar value (e.g. in a different location or online). When the client decided to ask for a refund, the terms of the previous point 1 are valid.
    • If Viviane decides to cancel the workshop or event (without an alternative offer), an email will be sent out offering alternative workshops which the ticket will be valid for. If such an offer cannot be made, ticket costs will be refunded within two weeks. The ticket buyer is responsible for reading these emails, including checking their Spam folder.
    • When a group event is not canceled but there are circumstances where certain measures are required because of government policies, refunds are not possible when everyone is, in principle, able to meet these measures.
  4. When a group event is cancelled by Viviane because of sickness or personal circumstances, an alternative date will be announced, and the tickets will be valid for that event. The terms of the previous point 1 are valid. With no alternative date, ticket costs will be refunded.
  5. Costs of a ticketing agency (e.g. Chipta, Hipsy, Eventbrite, etc) are never refunded, and neither will Viviane take responsibility for mistakes made by the ticketing agency. Viviane may be requested for support in contacting the ticketing agency where needed.
  6. When a ticket buyer disrespects the gender of the ticket, Viviane beholds the right to prohibit their entrance from the event without a refund.
  7. When a client disrespects boundaries or otherwise behaves inappropriately, Viviane has the right to withdraw access from the event immediately without refunding the ticket. Viviane beholds the right to refuse a client or refuse certain types of workshops with a client. Inappropriate behavior includes (but does not exclude other behavior):
    • Touching other participants, or team members, without prior consent.
    • Disrespectful language, including racism, misogyny, discrimination, ableism, etc.
    • Disrespecting guidance by Viviane and her team.
    • Disrespecting health measurements requested by Viviane and her team.
  8. Viviane beholds the right to refuse access to future events when a client behaves inappropriately according to the abovementioned point.

Group Event Guidelines

I will explain the below guidelines in more detail at the beginning of any and every group event that I host. I uphold a zero tolerance policy regarding the given guidelines, meaning that anyone not adhering to the guidelines may be asked to leave the event and might not be allowed to join any future events that I host.

  • Confidentiality
  • Consent
  • Respect of each other's needs and boundaries
  • Self-care

Ethics

My Ethical Guidelines

What

These Ethical Guidelines are basic principles of ethical behavior to which I or anyone who works as my representative or assistant, hereafter called 'service provider', voluntarily commit ourselves to offer my work in the safest way possible during individual sessions and group events – hereafter called 'session'.

Why

I recognize that in any situation where there is a client and service provider, there is an inherent power dynamic where most of this power rests with the service provider. To prevent this power from being abused, consciously or unconsciously, there is this ground ethics.

Professional agreements regarding ethical behavior and boundaries provide transparency to both service provider and client. These agreements make it possible to create a culture of mutual consent where both service provider and client can be held accountable for their behavior and, where necessary, follow-up actions can be taken in a clear and transparent manner.

Safety to explore is central to me. I am accountable for that safety when I invite people to areas where safety is necessary (such as individual session work and group events, etc.).

My core values

Confidentiality

At the beginning of each session, I remind my clients of the confidential setting, and what that means and means for the specific setting. This includes, for example, agreements regarding the anonymity of other attendees.

Anything shared within a session will be treated with professional confidentiality and not shared with others.

When I encounter clients outside of my professional activities, I will not disclose where I met them. I also will not disclose information about their identity, personal activities, status, sexuality, relationship preferences, or other potentially sensitive topics.

Freedom of choice in the session room

I encourage freedom of choice in participation, both at the start of a session and during. Pushing or coercing to participate is avoided under all circumstances.

A client does not have to leave the room in which the session is given if they do not want to participate (anymore).

A client has the freedom at any time and under any circumstance to terminate an interaction without reason, and/or to leave the session, whereby they are being asked to notify me or a team member, for information only (no explanation is demanded).

The service provider can also interrupt or end a session at any time if the well-being of the client or service provider requires so.

Exercises are generally sufficiently explained in advance by the service provider to give the client the opportunity to estimate whether they want to participate.

Clients are encouraged to modify exercises if their physical (or other) capabilities require it. As service provider, I encourage this.

In group settings, clients are not forced to do any exercise with a particular person. There will always be a possibility not to participate in the exercise in such a case. With exercises in pairs, it is never assumed that when exercises are done in one direction, it automatically happens in the other direction as well.

The service provider generally uses inviting terms (no affirmative or imperative form).

Inclusiveness and diversity

I am aware of social inequalities at the societal level. These include:

  • Gender (male/female ratios, transgender and non-binary experiences)
  • Sexual orientation (being LGBTQIA+, (internalized) homophobia and biphobia, asexuality)
  • Ethnicity and skin color (including institutional and everyday racism)
  • Body acceptance (the position of certain forms of bodies in society),
  • Age (the glorification and simultaneous infantilization of youthfulness, the glorification and simultaneous de-sexualization of seniority)
  • Ability (diversity of physical capabilities)
  • Neurodiversity (such as assumptions about "normal" and "desirable" social behavior and varying degrees of sensitivity to group dynamics)
  • Social class (such as awareness about education and access to education, employment, rural/urban background, social mobility)

In order to guarantee the security from which exploration is possible, I explicitly strive for a space that is inclusive towards minorities. For this, I do the following:

I believe in everyone's self-identification and make no assumptions about how someone identifies with regard to the above axes of identification (i.e. no assumptions about who someone is attracted to, for example).

When a session is not accessible to everyone (for example a session for neuro-diverse people or for self-identifying women), I am specific and clear about who the space is and is not suitable for. I also clearly indicate the reason and added value of this exclusivity.

I refrain from generalising, stereotyping, or deterministic statements about identity traits (avoiding statements about "men are like this, women are like that" or imitating "types" with racialized or class-destroying accents, for example).

In group exercises, I do not divide groups on the basis of identity characteristics. If this is desired for a practical reason (for example when an exercise is easier with people of similar height), we motivate my train of thought.

When I overlook something or do not adhere to my own standards and values, I like to be held accountable. I thank those who take the trouble to give me feedback and take their signal seriously.

Sexual and romantic connections between service provider and client

The relationship between client and service provider is not an equal connection. I recognize that there is a power difference between service providers (including their team of assistants, etc.) and clients. For this reason, I use guidelines regarding the possible establishment of a sexual or romantic connection with clients. I make a distinction between potential clients, existing clients, former clients, and people I knew before the service was provided.

Potential clients

Potential clients are people with whom I have not yet entered into a service provision.

When individuals with whom I have connections (family, friends, partners, partners of partners) consider entering into a professional service with us, and that seems appropriate within the context of the service (where an individual session with a partner may be inappropriate, participation in a workshop could potentially be appropriate), an open discussion is started in which the shift in power dynamics, impact on the existing connection and possibility of impact on shared connections are discussed, as well as possible agreements on both a professional and personal level.

Existing clients

Clients are people with whom I have entered into a service provision (paid or unpaid).

As a service provider, I do not enter into romantic or sexual connections with clients. Sexuality can be a theme within a session. In that case, sexuality in no form will take place outside this context of a session.

If the client and service provider will be present at the same group event, this will be discussed in advance, if possible, and agreements will be made about this.

Ex-Clients

No romantic or sexual connection is aspired within 6 months of cessation of professional activities. If a situation arises within 6 months in which it is desired to deviate from this rule, the service provider is obliged to contact assistants for reflection.

People I already have a connection with

Sometimes people with whom we already have a personal connection participate in a group setting. This connection originates in a situation without power dynamics and therefore differs from connections that arise within the power dynamics of the client/service provider dynamic and can therefore be seen as appropriate. Such a connection can give a client special status in a group setting, or create a feeling of insecurity for people who are not familiar with this relationship. When appropriate and contributing to the security of the setting, these connections will be disclosed at the start of a group setting.

When there is a personal romantic or sexual connection between team members (service provider and/or assistants), this will be disclosed, if appropriate and contributing to the safety of the setting.

Because situations between client and service provider do not always fit in the context of basic ethical principles, it is possible to deviate from the above. In such a case, the service provider will always request intervision and possibly supervision.

Being Trauma Informed

I strive to continuously learn about trauma, have sought education about trauma, the causes of trauma, and how to deal with trauma when it comes up in my clients. I select my assistants also on the basis of how trauma-informed they are.

I only work with clients with traumas (as far as I can reasonably know) that I believe I can handle safely when the trauma is touched. If I estimate that I cannot handle this safely, I will refer the client to colleagues.

Accountability

I value clarity, honesty and transparency. I refrain from spreading baseless misinformation, factual inaccuracies and lies. I do what we say, and if that doesn't align (or seems not to align), I want to be held accountable.

If an incident occurs, I prefer to be addressed personally. This can be done during my work or afterwards, in person or by e-mail.

Intellectual Property

Workshops and exercises are part of intellectual property of a business. As team member you may become inspired by what you learn in the workshops.

It is not okay for team members or participants to copy exercises or full workshops and facilitate them as your own. When in doubt about using your inspiration, check-in with the service provider.
